He was worried about whether his creditor could seize his business assets. I was nonplussed. I said to him: “but nobody has even sued you yet, have they?” He said no. “Then how are they going to seize anything from you?” First they would need to file an action against you. Then they would need to get a judgment. Then they would need to begin collection actions. They can’t just seize your bank account or other assets just because they claim you owe them money. It was then that I realized that my well educated business client, like so many other persons was giving way to fears because, despite my explanations he didn’t understand the law on this point.

The whole thing didn’t make any sense because, as I told him, I would never let matters get to that point. I would protect him. We could either settle his accounts or seek bankruptcy protection. We could also get an agreement with the creditor to delay any legal proceedings for several months too, a standard practice in some circumstances if he needed more time to come up with the money, etc. The thing I want to emphasize to you is that, if you have an attorney to represent you, you don’t need to worry about this stuff. Let your lawyer deal with the creditors. Tell him about all your issues, and you and he can come up with a reasonable plan to get you out of debt.

But my client was worried about it anyway. I said “you wake up in the middle of the night and think about all this stuff don’t you?” He said yes. If that sounds like you, you’re not alone. There are literally millions of people who wake up before dawn and lie in bed worrying about their financial future.

I’m here to tell you that your fears are probably exaggerated. There are ways to settle or get rid of your debts if you have expert help. But, the biggest thing that struck me was how worried clients would get over dealing with their creditors. They would literally wake up in the middle of the night and feel overwhelmed. When I talk to them I tell them “don’t worry, I’ll handle it. We’ll negotiate something with your creditor or we’ll seek bankruptcy protection. Either way, you don’t have to sit there and feel overwhelmed.”

It impacts their health, their marriage, their relationship with their children, their jobs, their interactions with the entire world. It doesn’t have to be this way.
